terminate subscriptions, remove or edit content, or cancel orders in its sole

Payment for your subscription will be made on the date you place your order
for the Service. The subscription term will commence on the date you register
for the Service and continue until terminated as provided below. Current
subscription rates are available on the description
of services page.
Subscription Termination
New subscriptions in the service offer a free trial period during which you may
cancel that subscription anytime and not be charged once the free trial has
expired. Check the length of the guarantee period for each particular
subscription by clicking on the subscription name in the Directory. The free
trial is available only once per individual per subscription. To cancel your
subscription during the free trial period, you must call Hot Stix at (866)
227-9224. Cancellation requests via email will not be accepted.
Subsequent to the free trial period of your subscription, you may cancel your
subscription at any time. However, there are no refunds or credits issued after
the free trial period nor if you have received a refund previously. To cancel
your subscription to the Service after the free trial period, you must call Hot
Stix at (866) 227-9224. Cancellation requests via email will not be accepted.
We reserve the right to terminate your subscription and use of the Service at
any time for any reason, including without limitation any breach by you of this
Agreement of these Terms of Service.
Automatic Subscription Renewal
Your subscription(s) will renew automatically according to the payment plan you
selected and authorized at the time of purchase; unless you notify us 4 days
prior to such renewal of your decision not to renew your subscription by
contacting Hot Stix at (866) 227-9224. Cancellations and renewal requests made
via email will not be accepted.
The Service may provide hyperlinks to third party websites or access to third
party content. Hot Stix, Inc. does not control, endorse, or guarantee content
found in such sites. You agree that Hot Stix, Inc. is not responsible for any
content, associated links, resources, or services associated with a third party
site. You further agree that Hot Stix, Inc. shall not be liable for any loss or
damage of any sort associated with your use of third party content. Links and
access to these sites are provided for your convenience only.
YOU EXPRESSLY UNDERSTAND AND AGREE THAT:
1. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN
"AS IS" BASIS. HOT STIX, INC. EXPRESSLY DISCLAIMS ALL WARRANTIES OF

2. HOT STIX, INC. MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR
REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR
ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USER OF THE SERVICE
WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES,
INFORMATION, NEWSLETTERS OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH
THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (v) ANY ERRORS IN THE WEB SITE OR
THE SOFTWARE WILL BE CORRECTED.
3. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE

STIX, INC. OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT
EXPRESSLY STATED IN THE TERMS OF SERVICE.
YOU EXPRESSLY UNDERSTAND AND AGREE THAT HOT STIX, INC. SHALL NOT BE LIABLE FOR
ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES,
INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA,
OR OTHER INTANGIBLE LOSSES (EVEN IF HOT STIX, INC. HAS BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES), RESULTING FROM (i) THE USE OR INABILITY TO USE
THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AN SERVICES
RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED
OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE;
(iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv)
STATEMENTS OR CONDUCT OF ANY THIRD PART ON THE SERVICE; OR (v) ANY OTHER MATTER
RELATING TO THE SERVICE.
CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE
EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR
ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU,
AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
You agree to defend, indemnify, and hold harmless Hot Stix, Inc., employees,
attorneys, and agents against all claims, expenses, liabilities, losses, costs,
and damages, including reasonable attorney's fees made by any third party due
to or arising out of content you submit, post, transmit, or made available
through the Service, your use of the Service, your connection to the Service,
your violation of the Terms of Service or your violation of any rights of
another.
All matters relating to your access to and use of the Service shall be governed
by the law of the state of Delaware without regard to its conflict of law
principles. Any legal action or proceeding relating to your access to or use of
the Service must be instituted in a state or federal court in the state of
California, county of Los Angeles and you expressly consent to the jurisdiction
of these California courts.
If there is a determination that any provision of these Terms of Service is
invalid or unenforceable, that determination will not affect the rest of the
Terms of Service and the Terms of Service shall be deemed amended to the
minimum extent necessary to make them valid and enforceable.
